Welcome to Ballpark. By accessing or using ballpark.games and our associated game services ("the Service"), you agree to be bound by these terms. If you do not agree, please do not use the Service.
Ballpark is a multiplayer estimation game available through a web browser. The host of a game session pays for access; players who join a host's room play for free. Solo training mode may be available as part of a paid subscription or purchase.
You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us if you believe your account has been compromised.
Payments are processed securely through Stripe. All prices are displayed in US dollars unless otherwise indicated. Because Ballpark is a digital product delivered immediately upon purchase, all sales are final. If you experience a technical issue that prevents you from accessing content you've paid for, contact us at support@ballpark.games and we will work to resolve it or issue a refund at our discretion.
You agree not to use the Service to engage in any activity that is unlawful, harmful, or disruptive to other users. This includes but is not limited to: attempting to manipulate game outcomes through automated tools or scripts, harassing other players, reverse-engineering the Service, or attempting to access accounts or data belonging to others.
All content on Ballpark — including questions, fun facts, artwork, audio, design, and code — is owned by us or our licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.
If you submit a display name or other content visible to other players, you grant us a non-exclusive, royalty-free license to display that content within the game. You are responsible for ensuring that any content you submit does not violate the rights of others.
We strive to keep Ballpark available and running smoothly, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We are not liable for any loss or inconvenience caused by downtime.
We reserve the right to suspend or terminate your account if you violate these terms or engage in conduct that we determine is harmful to the Service or its users. You may also delete your account at any time by contacting us.
To the fullest extent permitted by law, Ballpark and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or available at all times. While we strive for accuracy in our game content, Ballpark is an entertainment product and should not be relied upon as a source of factual information for any purpose beyond gameplay.
These terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes arising from these terms or the Service will be resolved in the courts located in Los Angeles County, California.
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised terms. We will make reasonable efforts to notify users of material changes.
